Please read these Terms of Service ("Terms") carefully before using the Kin mobile application ("App") operated by Kin App ("we", "us", or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Acceptance of Terms

By creating an account or using any part of the App, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. We may update these Terms from time to time; continued use of the App after changes constitutes acceptance of the revised Terms.

2. Account Registration

You must be at least 13 years of age to create an account and use the App.
You must provide accurate, current, and complete information during registration.
You are responsible for maintaining the confidentiality of your account credentials.
You are responsible for all activity that occurs under your account.
You may not create accounts for other people without their permission, or create multiple accounts for deceptive purposes.

3. Acceptable Use

You agree not to use the App to:

Harass, bully, threaten, or intimidate other users.
Send spam, unsolicited messages, or automated content.
Post or share illegal content, including but not limited to content that violates intellectual property rights, promotes violence, or constitutes hate speech.
Impersonate another person, entity, or organization.
Attempt to gain unauthorized access to other users' accounts or any part of our systems.
Use the App for any unlawful purpose or in violation of any applicable local, state, national, or international law.
Reverse-engineer, decompile, or disassemble any part of the App.
Interfere with or disrupt the App or its servers and networks.

We reserve the right to investigate and take appropriate action against anyone who violates these rules, including removing content, suspending accounts, and reporting to law enforcement where appropriate.

4. User Content

Ownership: You retain ownership of the content you create and share through the App, including posts, messages, photos, and voice messages.
License: By posting content on the App, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content solely for the purpose of operating and providing the App.
Ephemeral content: Some content on the App is designed to be short-lived. Live location and presence data expire automatically (typically within minutes). Posts and other content may have limited visibility based on proximity or time. However, messages and certain content are retained for the duration described in our Privacy Policy.
Responsibility: You are solely responsible for the content you share. Do not post content you do not have the right to share.

5. Location Data

The App uses foreground location access only — your location is collected while the App is actively in use, not in the background.
You control how your location is shared through privacy modes: Exact, Approximate (~500m jitter), or Off.
You can change your location privacy mode, disable nearby discovery, and control live location sharing to friends at any time in Settings.

6. Termination

By us: We may suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in abusive behavior, or if required by law.
By you: You may delete your account at any time through the App's Settings. Upon deletion, we will remove your profile and associated data as described in our Privacy Policy.
Effect of termination: Upon termination, your right to use the App ceases immediately. Sections of these Terms that by their nature should survive termination will continue to apply.

7. Disclaimers

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not warrant that the App will be uninterrupted, secure, or error-free. You use the App at your own risk.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KIN APP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $50 USD, whichever is greater.

9. Changes to Terms

We may revise these Terms from time to time. If we make material changes, we will notify you through the App or by other reasonable means. Your continued use of the App after the effective date constitutes acceptance.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Kin App operates.
